Introduction (Service Coverage) The scheme aims to help settle consumer disputes promptly and effectively, and thus to protect the rights of consumers and augment the status of the businesses. Businesses joining the ‘Adherent’/ ‘Certified Shop’ scheme are obliged to resolve consumer disputes and this obligation give confidence to consumers.

Target Groups and Application Eligibility Any retail business operating in Macao that agrees to submit and resolve the disputes in the Consumer Arbitration Centre (not applicable to liberal professionals)
Application Procedures
  1. The company applying to become an ‘Adherent’ need to submit:
    1. ‘Adherent’ application form provided by Consumer Council;
    2. Original copies of the letters of undertaking and declaration;
    3. A legible copy of the Business Registration Tax-Form M/1 –New Registration/Amendment Form;
    4. A legible copy of the Business Registration Tax-Form M/8-Tax Demand Note;
    5. A legible copy of the front and back of the signatory’s ID card;
  2. If a person who signs on the application form is not the holder of the business license or a corporate representative , the following document is, therefore, needed:
    1. Original copy of authorization letter (Certified true copy thereof may be accepted if the original copy is not available);
  3. If the business who is running other businesses that are not on the list of the application form, the following document is also needed :
    1. Original copy of declaration of holding concurrent businesses;

Remarks

  1. The application form shall be signed by a legal representative of the enterprise in accordance with the specimen of signature as indicated on his/her identity card coupled with a company seal affixed thereon. In case of an individual enterprise (or Sole Proprietor), the owner of the enterprise represents himself as the legal representative. Should a commercial enterprise be set up in form of limited company, the legal representative is equivalent to a person who can represent the enterprise to participate in litigation or arbitration under the Articles of Association. (In the event that a member of an Administrative Authority is entitled to represent the enterprise, it means that the member of an Administrative Authority is regarded as a legal representative.)
  2. The business that has joined the ‘Adherent’ scheme shall accept that, should any consumer dispute arise with a consumer, and that the dispute occurs in Macao with a claim involved amounted to MOP$100,000 or below, and upon receipt of the consent/request of the complainant, the dispute must be resolved through arbitration under Section 1 of ‘Consumer Arbitration Centre Regulations’.
  3. Detailed information regarding ‘Consumer Arbitration Centre’, ‘Adherents’, ‘Certified shops’ and ‘Codes of Practice’ on various retail industries can be found respectively in the leaflets issued by Consumer Council.
  4. Should the business provide sufficient information for the application of ‘adherent’ and with a good business record, a representative from Consumer Arbitration Centre will carry out an on-site evaluation to assess if the business is eligible to join the scheme and a decision is made within 10 working days. The business is assessed based on a number of criteria, namely: the surroundings of the shop, service attitude of staff, marketing strategies and operating system, etc..
  5. During the first year as the ‘Adherent’, the business shall be law-abiding and conform to the Regulations and Code of Practices of ‘Certified Shops’ (if applicable). The business should have a good business record and it will then be awarded the annual ‘Certified Shop’ emblem when it passes the annual assessment.
  6. The business will be, merely, eligible to the emblem of ‘Certified Shop’ in the following year if it has passed the annual assessment.
  7. By the end of each year, the Arbitration Centre provides recommendations for improvements and notifies the assessment results to the shops respectively, and the Centre has the right to publicize such recommendations and assessment results.

A representative of Assessment Committee will take a photo of the shop front after the on-site evaluation and thereafter upload such photo and basic information (as marked # on the application form) of the business to the Council’s official website for promotion.

Performance Pledge

Eligibility of ‘Adherents’ : It takes 10 working days for approval upon receipt of the application form and related information from the enterprise/business
Eligibility of ‘Certified Shops’ : Approval of ‘Certified Shops’ : Businesses which have been accepted as ‘Adherents’ and have passed the assessment by the Consumer Council on completion of one year calculating from the month of being accepted as ‘Adherents’ will be awarded the ‘Certified Shop’ emblem.

Remarks : Consecutive twelve months are calculated as a year commencing from the month of being accepted as ‘Adherents’.
